Inhofe Bill To Kill EPA Air Toxic Rule Loses 46-53

Senator Inhofe's effort to kill the EPA air toxic rule won this afternoon the support of 46 senators but drew the opposition of 53.  The bill needed 50 votes to pass.

The roll call on the vote largely followed party lines but not completely.  Forty-one Republicans voted for Inhofe's bill but 5 Republicans voted against it.

On the Democratic side, 48 Democrats voted against the bill, while 5 voted to kill the EPA air toxic rule.

President Obama had promised a veto of the bill had it passed the Congress.

Energy analysts have calculated that the air toxic rule would increase natural gas demand by 1 trillion cubic feet per year if it is implemented.  Natural gas generation power plants meet the air toxic rule, because burning natural gas emits essentially none of the regulated pollutants.

While the EPA rule has now survived the challenge in the Senate, it faces substantial challenges in the courts.  The Bush Administration's version of this rule was struck down by the courts, and returned to the EPA, where President Obama found it and a court order to enact a new rule, when he took office.

Given the judicial history with this rulemaking, whether the rule will go into effect remains uncertain.
